In a criminal case the state may have a continuance to the next term of court when defendants actions have substantially inhibited the prosecutors trial preparation. Such continuance violates neither the federal or state constitutions nor W.Va. Code, 62-3-1, which requires that a defendant be tried at the term of court in which he is indicted unless good cause be shown for a continuance.
